Terms of Service

These terms are the contract between FreshGeo Ltd (“FreshGeo”, “we”, “us”) and the person or company using our service (“you”, “Customer”). Read them. By signing up, you’re agreeing to them.

1. The service

FreshGeo provides a data-API and associated dashboard that lets customers query competitor pricing, buying intent, hiring, social, real estate, competitor change and news/risk data. We sell it on subscription.

2. Your account

You need a valid account to use FreshGeo. You’re responsible for:

  • Accurate signup details.
  • Keeping credentials secret.
  • Everything that happens under your account.

Tell us immediately at security@freshgeo.com if you suspect your account is compromised.

3. Acceptable use

You agree you will not:

  • Resell, sublicense or white-label the service without a written reseller agreement.
  • Use the API for unlawful surveillance, stalking, harassment, or to build discriminatory profiles.
  • Reverse-engineer, decompile or attempt to extract the underlying dataset in bulk for re-hosting.
  • Run benchmarks and publish results without our prior written consent.
  • Ignore robots.txt or site terms when using FreshGeo data to drive your own downstream crawling.
  • Probe, scan or attack our infrastructure.
  • Use the service to send spam or malware.

4. Fees, overages and tax

  • Fees are in GBP and billed monthly or annually in advance.
  • VAT is added where applicable (UK VAT, EU reverse charge, etc.).
  • Usage above your plan’s included quota is billed at the overage rate listed on your plan page.
  • We can change prices with 30 days’ notice for the next renewal. Current term pricing is locked.
  • Late payments accrue interest at 4% above Bank of England base rate.

5. Data ownership and licences

Your data is yours. Anything you submit (queries, uploads, configuration) remains your property. You grant us the limited licence needed to operate the service for you.

Our output is ours. The API response data, rankings, enrichments and dataset structure are FreshGeo IP. When you’re a paid customer in good standing, we grant you a worldwide, non-exclusive, non-transferable licence to use API output inside your products and workflows for the duration of your subscription. You can keep results you’ve already pulled after termination, but you can’t re-query or redistribute the raw dataset.

6. Service level (SLA)

  • Scale and Enterprise plans: 99.9% monthly uptime (99.95% / 99.99% available).
  • If we miss it, you get service credits: 10% of monthly fee for <99.9%, 25% for <99.0%, 50% for <95.0%.
  • Credits are your sole remedy for downtime.
  • Scheduled maintenance (announced 48h in advance) and force majeure don’t count against uptime.

7. Support

  • Starter: email, best effort.
  • Scale: email, next business day; priority chat, 4h.
  • Enterprise: email + Slack, 1-hour first response on P1 issues, 24/7.

8. Warranties and disclaimers

We warrant that we’ll provide the service with reasonable skill and care. Beyond that, the service is provided “as is”. FreshGeo data comes from public and third-party sources — we don’t warrant it’s complete, accurate, or current for your use case. Test it against your own criteria before relying on it.

9. Liability

Nothing in these terms limits liability for death, personal injury caused by negligence, or fraud.

Subject to that, our total liability is capped at the fees you paid us in the 12 months before the claim. Neither party is liable for indirect, consequential, or loss-of-profit damages.

10. Indemnity

You’ll indemnify us against claims arising from your unlawful use of the service or your breach of section 3 (Acceptable use).

11. Term and termination

  • Subscriptions auto-renew unless cancelled.
  • Monthly plans: cancel anytime, effective end of current period.
  • Annual plans: cancel anytime, effective end of current term. See Refund Policy for pro-rata.
  • We can terminate for material breach with 14 days’ notice to cure (or immediately for abuse, illegal use, or non-payment over 30 days).
  • On termination, we delete your account data within 30 days unless legally required to retain it.

12. Suspension

We can suspend your access without notice for security incidents, breach of section 3, or non-payment older than 14 days after reminder. We’ll restore access as soon as the issue is resolved.

13. Governing law

These terms are governed by the laws of England and Wales. Disputes go to the exclusive jurisdiction of the courts of London, England.

14. Changes

We may update these terms. Material changes get 30 days’ notice by email to account admins. Continued use after that means you accept.
